Georgia State's DUI Lookback Period
In Georgia, there is a "lookback" period often years for DUI-related violations. To think of it another way, a DUI charge will be "active" on your record for 10 years. This means that if you were arrested in 2015 for a DUI and were also arrested in 2006 for a DUI, your penalties will escalate.
Penalties tend to scale predictably, with a first-time violation being the least severe:
- First offense:Up to one year in jail, $300 to $1,000 in fines, and up to one year of license suspension.
- Second offense:Up to one year in jail, $600 to $1,000 in fines, and three years of license suspension.
- Third offense:At least two weeks in jail, $1,000 to $5,000 in fines, five years of license suspension, and an ignition interlock device.
- Fourth offense:One to five years in prison, a $5,000 fine, a permanent license revocation, and an ignition interlock device installed onto any vehicle you operate.
Other consequences could befall you on a conviction for any violation, such as community service and enrollment in DUI risk reduction programs.
